Recently, lots of 457 nomination refusals in relation to Marketing specialist position. Here’s an extract of the decision, might be useful for other migration agents or applicants:
In assessing Regulation 2.72(10) (f) I have considered the size, structure and operations of the business, as well as the ANZSCO description of the nominated occupation. According to ANZSCO, a Marketing Specialist 225113 is a high level, specialised role that makes strategic contributions including developing and coordinating advertising strategies and campaigns, identifying market opportunities and advising on the development, coordinating and implementing of plans for pricing and promoting an organisation's goods and services.
The high level, specialised nature of the role is reflected in the skill level (as specified in ANZSCO) being a bachelor degree or higher qualification or at least five years of relevant experience. Given the far reaching impact of this senior role that significantly shapes organisations and business direction, the role of Marketing Specialist 225113 is typically associated with organisations operating within a competitive and complex business environment, with a significant number of staff, resources, services/product lines and client commitments. The position would therefore be relevant within relatively large business operations.
….Departmental records show that the business employs no more than ten(10) staff. In making my assessment I have closely consider, the size, scale and structure of the business and I am satisfied that the business is not of sufficient size to support such a high level role.
As a former HR manager in Hyundai motors group, We believe the case officer has no idea about what the marketing specialists are actually doing in the large organization or does not want to give him/her a visa or the migration agent couldn't prepare it well because the position had got approved a year ago.
The above under-lined job description is for the one who actually directs the large company's marketing policy or is at least a senior vice president in a large-global organization. The majority staffs in marketing departments as marketing specialists are analysing statistics or preparing documents for lots of meeting (sometimes those are useless) or implementing marketing plans driven from the top to the branches.
THE 457 visa program is not merely designed to sponsor a Marketing Director or CEO or a Sales and Marketing Manager for large-global companies, which are already hot issues to the locals who do not need work visas. This Coalition government is stressing it's focusing on small businesses in terms of job creation and long-term prospective to the small businesses, but seems like out of touch how desperate the small business owners are struggling to find a right person, who might be able to bring their business a fortune.
Ask your friends who are working for large companies such as Woolworth, Big 4 Banks or Samsung Electronics or Apple or Google or Hyundai Motors, especially in Marketing departments or Division, about what they are doing as a marketing admin or specialist. With the immigration's criteria, no one can be nominated as Marketing specialist or Marketing Managers, even though their official titles are marketing specialists and they have at least a bachelor's degree from renowned university with years of experiences in the marketing sector.
That's why we've always urged to the department of immigration to provide their staffs, especially working at business skilled visas or sponsorship visas division where Nomination or Sponsorship process is required, with training programs such as organizational behaviour or human resources management or on the job training at HR department in large or global companies in order to understand how to interpret the meaning of ANZSCO dictionary more practically by reflecting actual work-environment, not just heavily relies on the books.
