Two Malaysian workers of Chinese descent in Australia on temporary visas were deliberately exploited, underpaid and discriminated against by a Tasmanian hotel operator because of their race, a Federal Circuit Court judge has ruled.

Reg 5.19(4) The requirements to be met for the nomination to be approved are as follows:
(a) the application is made in accordance with subregulation (2);
(b) either:
(i) there is no adverse information known to Immigration about the nominator or a person associated with the nominator; or
(ii) it is reasonable to
disregard any adverse information known to Immigration about the nominator or a
person associated with the nominator;
